WEMF AG für Werbemedienforschung (hereinafter ‘WEMF’) is committed to protecting your personal data and safeguarding your privacy. You can expect WEMF to handle your data sensitively and carefully and to ensure a high level of data security.
This privacy policy applies to all data processing in the context of relationships with you, unless we provide any additional or specific information.
You can expect us to handle your data sensitively and carefully and to ensure a high level of data security. Consequently, we consider it a matter of course to comply with the Swiss Federal Act on Data Protection (‘FADP’), the associated regulation and other applicable data protection provisions, in particular the EU General Data Protection Regulation (‘GDPR’). However, whether and to what extent these laws are applicable depends on the individual case.
This privacy policy describes what WEMF does with your data when you visit this website, purchase services or products from WEMF, otherwise have a contractual relationship with WEMF, communicate with WEMF or otherwise deal with WEMF.

II. General information on data processing
1 Types of personal data processed
WEMF primarily processes personal data that is collected as part of its business relationships and in order to conduct media and advertising studies. In particular, this includes the data of business contacts, clients, users of their digital platforms, subscribers, event participants, applicants and survey participants.
The data is either made available directly by the data subjects (e.g. through enrolment, registration, application or participation in surveys) or transmitted or collected automatically when using digital services or by third parties (e.g. service providers).
Depending on the context, WEMF processes the following categories of personal data in particular:
- Master data (e.g. surname, first name, title, business contact details (address, email address, telephone number), company affiliation, role, sector, language)
- Contractual and financial data (e.g. type of contract, content of contract, applicable terms and conditions, start of contract, contract term, invoice data, payment information, other business data)
- Communication and support data (e.g. correspondence in the context of contact requests, support requests, newsletter interactions, feedback from surveys)
- Consent and preference data (e.g. opt-ins for newsletters, communication preferences, consent to participation in studies).
- Usage and tracking data (e.g. IP address, date and time of access, websites visited, referrer URL, device and browser settings, cookies, log data)
- Login and profile data for digital platforms (e.g. username, roles and permissions, registration and login data, usage history in tools such as MedienDB, Agency.OS, NEXT>LEVEL)
- Event data (e.g. registration details, participation logs, feedback on WEMF training sessions, webinars and physical events)
- Application documents (e.g. CVs, cover letters, testimonials, references and other application-related information)
As part of its research activities, WEMF collects the following additional categories of personal data as part of telephone or online-based surveys (e.g. MACH studies):
- Survey and interview data (e.g. demographic characteristics (age, gender, education, household structure), media use (e.g. preferred channels, reach), consumer behaviour (e.g. purchasing behaviour, brand preferences), advertising impact, political and social attitudes (only with consent)
- Technical and organisational metadata (e.g. interview time, duration, type of interview (telephone/online), interview ID, contact attempts, participation status)
- Contact and follow-up data (if required) (e.g. telephone number, email address; for queries, verification, incentives, re-contact surveys [MACH Consumer/MACH Basic] or optional re-recruitment by partner institutes; in each case only with prior information/consent)
Depending on the study design, (1) survey and interview data and (2) technical and organisational metadata is processed in anonymised or pseudonymised form wherever possible. Personal details are usually separated from the rest of the data set at an early stage and are not transferred to analyses or publications. Participation in the surveys is voluntary and is explained transparently in advance. WEMF works with specialist survey institutes that are contractually bound to confidentiality and compliance with data protection regulations.
2. Purposes of data processing
WEMF processes personal data in order to fulfil its contractual, legal and statutory obligations in the area of media and advertising research as well as quality assurance in the Swiss advertising market.
WEMF uses personal data collected or received for the following purposes in particular:
- Contract execution: to establish, manage and execute contractual relationships with customers, licensees and clients (e.g. use of databases, implementation of certifications, media research services)
- Conducting studies and surveys: for organising, coordinating and conducting telephone and online surveys (e.g. as part of the MACH studies), including making contact, conducting interviews, providing incentives and validating and evaluating results
- Referral to access pool provider: after completion of the survey, WEMF reserves the right to refer participants to an external access pool provider. These providers run their own panels with people who regularly take part in surveys. Contact details will only be passed on if the data subject was transparently informed about this purpose during the initial survey and has expressly agreed to it. The access pool provider will only contact participants to invite them to join its own panel and is subject to its own privacy policy.
- Service offering and further development of products and services: for the design, improvement and quality assurance of existing services such as MedienDB, NEXT>LEVEL and Agency.OS and for the development of new data-based services
- Operation and further development of the website and IT infrastructure: to ensure the secure, stable and user-oriented operation of digital platforms and to analyse user behaviour (e.g. by means of log files and cookies)
- Implementation of training and development programmes: for example, as part of the WEMFacademy, including registration, implementation, evaluation and documentation
- Communication and enquiry processing: for processing enquiries made via forms, email or telephone, as well as for general business communication
- Marketing and events: for direct marketing to potential and existing customers (e.g. sending specialist information, newsletters, invitations to events), provided no objection has been raised
- Market and opinion research: for internal analyses, study comparisons, trend monitoring and quality assurance
- Application process: to check and process incoming applications
- Target group analysis/segmentation: for analysing user groups and for data-based optimisation of services.
- Documentation and archiving: for the structured storage and traceability of business processes, studies or legally relevant procedures
- Legal purposes: to assert legal claims, to defend against legal disputes and to comply with statutory retention and documentation obligations
- Safeguarding legitimate interests: for example, fraud prevention, misuse prevention, IT and access security and safeguarding contractual or legal claims
If a data subject has given WEMF express consent to the processing of certain data, the processing is carried out based on this consent. Consent that has been given can be revoked at any time with effect for the future. This does not affect any processing that has already been carried out.
Processing may also be based on contractual grounds, legal obligations or the legitimate interests of WEMF, in particular to safeguard research interests, to ensure data quality or to continuously improve the services offered.
WEMF engages external service providers for certain activities, in particular to conduct telephone or online surveys. They are contractually obliged to comply with data protection regulations and to process data exclusively within the scope of WEMF’s policies.
3. Legal basis for processing
If the legal basis is not specified in the privacy policy, the following applies: data processing may be based on consent. Processing can then be used to fulfil services, to implement contractual measures and to respond to enquiries. Furthermore, processing may be based on the legitimate interests of WEMF or on legal obligations.
4. Your rights
Within the scope of the data protection law applicable to you and to the extent provided for therein, you have the following rights:
Right of access: you have the right to request information about whether your personal data is being processed and, if so, which data is being processed.
Right to rectification: You have the right to have incorrect or incomplete personal data rectified.
Right to erasure: you have the right to have your personal data erased under certain circumstances. In individual cases, in particular in the case of statutory retention obligations, the right to erasure may be excluded. In this case, the data may be blocked instead of erased, provided that certain conditions are met.
Right to data transfer: you may have the right to request the release of certain personal data in a commonly used electronic format or its transfer to another controller.
Right to object: you have the right to object to the processing of your data, in particular for the purposes of direct marketing, profiling conducted for direct marketing and other legitimate interests in processing.
Withdrawal of consent: you have the right to withdraw your consent to the processing of your personal data at any time, with future effect.
Right to further information: you have the right, upon request, to receive further information that is necessary to exercise these rights.
Automated individual decisions: in the case of automated individual decisions, you have the right to state your point of view and to request that the decision be reviewed by a natural person.

Right to lodge a complaint: you also have the right to assert your claims in court or to lodge a complaint with the competent data protection authority.
Please note that conditions, exceptions or restrictions apply to these rights (e.g. if WEMF is obliged to store or process certain data, has an overriding interest in it or needs it to assert claims). WEMF will inform you accordingly where necessary.
5. Data deletion and storage period
Unless expressly stated in this privacy policy, WEMF will process and store your personal data only for as long as is necessary to fulfil contractual and legal obligations or otherwise for the purposes pursued by the processing and beyond that in accordance with the statutory retention periods. As soon as your personal data is no longer required for the above-mentioned purposes or a prescribed retention period expires, your personal data will be routinely blocked or erased in accordance with the statutory provisions.
6. Data security
WEMF takes appropriate technical and organisational measures to ensure the security of your personal data and to protect it against unauthorised or unlawful processing and/or against unintentional loss, alteration, disclosure or access. These security measures include IT and network security solutions, encryption of data carriers and transmissions, access controls and restrictions, the issuance of policies, confidentiality agreements and controls. The security measures are regularly reviewed and adapted to the state of the art. WEMF also requires its sub-contracted data processors to take appropriate security measures. However, security risks cannot be ruled out completely; residual risks are unavoidable.
7. Data transfer
WEMF treats your personal data as confidential and only discloses it if you have expressly consented to this, if this is necessary for initiating or processing a contract, if there is a legal obligation to do so, or if this is necessary to enforce rights, in particular to enforce claims arising from the contractual relationship or other rights, or if the processing takes place to safeguard a legitimate interest of WEMF or a third party.
In addition, your data will be passed on to third parties to the extent necessary for the use of the website to provide the services requested by you (including outside the website) and to analyse your user behaviour. Insofar as this is necessary for the purposes mentioned in sentence 1, the data may also be transferred abroad. If the website contains links to third-party websites, WEMF has no influence on the collection, processing, storage or use of personal data by the third party once you click on these links and assumes no responsibility for this.
The categories of recipients include in particular:
- Commissioned service providers: e.g. external institutes to conduct surveys (telephone/online), hosting providers, survey platform providers, IT service providers, cloud service providers, shipping/logistics service providers, newsletter mailing services, CRM system operators, video conferencing and webinar platforms, etc.
- Cooperation partners: e.g. specialist agencies, data suppliers, research partners or participating organisations in the context of studies or projects (if necessary, in pseudonymised or aggregated form)
- Data recipients with their own processing purpose: in certain cases, after completing a survey, WEMF may refer participants to external partner institutes that operate their own panels or access pools. Only with the prior express consent of the data subject, these institutions are given access to selected contact details in order to invite them to participate in their own panel. These institutes do not act on behalf of WEMF, but rather as independent controllers.
- Commissioners of studies: if a data subject has expressly consented to disclosure for a project-related purpose or the data has been anonymised or aggregated
- Authorities and government agencies: if there is a legal obligation to provide information, cooperate or disclose (e.g. as part of statistical, tax or court proceedings)
- Legal representation, insurance or courts: in connection with the defence or assertion of legal claims
All these categories of recipients may in turn involve third parties, meaning that your data may also become accessible to them. WEMF also allows certain third parties to collect personal data from you on this website and at WEMF events on their own responsibility (e.g. media photographers, providers of tools that we have integrated into this website, etc.). Insofar as WEMF is not decisively involved in this data collection, these third parties are solely responsible for this. If you have any concerns or wish to assert your data protection rights, please contact these third parties directly.
In its collaboration with external service providers, WEMF uses carefully selected processors who are contractually bound to confidentiality and compliance with the applicable data protection requirements. WEMF takes appropriate contractual, technical and organisational measures to ensure that personal data is processed exclusively in accordance with the relevant policy.
8. Data transfer abroad
The recipients of your personal data listed in section 8 are generally located in Switzerland and the European Economic Area (EEA).
In exceptional cases, however, WEMF may also export or transfer personal data to other countries (worldwide), provided that the laws of those countries guarantee adequate data protection in accordance with the resolution of the Swiss Federal Council (countries in accordance with Annex 1 of the Data Protection Regulation and certified US companies in accordance with the Swiss-U.S. Data Privacy Framework) and – if and insofar as the General Data Protection Regulation (GDPR) is applicable – in accordance with the decision of the European Commission. These are typically providers of IT services, cloud platforms or communication systems. The list of certified companies and further information on the Data Privacy Framework can be found on the website of the U.S. Department of Commerce.
If a recipient is located in a country without adequate statutory data protection, it is contractually obliged to comply with the applicable data protection regulations (for this purpose, the EU standard contractual clauses of the European Commission are concluded, which can be found at https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj), unless the recipient is already subject to a legally recognised set of rules to ensure data protection and WEMF cannot rely on an exception clause. An exception may apply in the case of legal proceedings abroad, but also in cases of overriding public interests or if contract processing requires such disclosure, if you have given your consent or if it concerns data that you have made generally accessible and the processing of which you have not objected to.
III. Special notes on data processing
1. Server log files
This website is hosted in Switzerland. When you access this website, the browser used on your device automatically sends data to the server of this website. This data is temporarily stored in a log file, known as a server log file. This data includes in particular your IP address, the operating system used and your browser, the date and time of use, the website from which you are accessing the site and similar information. This information does not allow any conclusions to be drawn about you personally.
This data is processed exclusively for the purpose of operation (establishing a connection), system security and stability, the optimisation of your offer and for internal statistical purposes, i.e. on the basis of legitimate interests. This data will not be passed on to third parties or evaluated in any other way. No personal user profile will be created.

2. Newsletter and marketing emails
If you would like to subscribe to the newsletter offered on this website, WEMF requires in particular your first name and surname, your title and your (valid) email address, which allows us to verify that you are the owner of the email address provided or that the owner of the email address agrees to receive the newsletter. No further data will be collected, or only on a voluntary basis. This data will be used exclusively for sending the newsletter. Your name is provided so that we can address you personally in the newsletter and, if necessary, identify you if you wish to exercise your rights as a data subject.
Registration for the newsletter takes place through a ‘double opt-in’ procedure. This means that you will receive an email after registering, in which you will be asked to confirm your registration. This confirmation is necessary to prevent anyone from registering with someone else’s email address. The registrations for the newsletter are logged in order to be able to prove that the registration process complies with the legal requirements. This includes the storage of the registration and confirmation time as well as the IP address. Changes to your data stored by the shipping service provider are also logged.
The basis for the processing of your personal data after subscribing to the newsletter is your consent or, if consent is not required, WEMF’s legitimate interests in direct marketing, provided that this is permitted by law, e.g. in the case of advertising to existing customers. For the processing of your personal data, your consent is therefore obtained during the registration process and reference is made to this privacy policy.
Registration and dispatch of the newsletter is carried out via the mailing service provider MailChimp, a newsletter mailing platform of The Rocket Science Group LLC, a company of Intuit Inc, based in the USA. Mailchimp’s server is located in the USA. This means that your data may be transferred to the USA or other countries where MailChimp or Mailchimp’s sub-contracted processors maintain facilities, and stored or processed there. Corresponding contracts (EU standard contractual clauses) and other obligations of Mailchimp (‘Data Processing Addendum’) are used to ensure an adequate level of protection. You can find MailChimp’s privacy policy here. WEMF has a legitimate interest in involving MailChimp. WEMF is interested in using a user-friendly and secure newsletter system that serves both the business interests of WEMF and meets the expectations of its users.
You can unsubscribe from the newsletter at any time and withdraw your consent. A link to unsubscribe from the newsletter can be found at the end of each newsletter. Alternatively, you have the option of sending your consent withdrawal to the following email address: datenschutz@wemf.ch
3. Enquiries and contact form
If you submit an enquiry via the contact form, your details from the enquiry form will be stored for the purpose of processing the enquiry and handling it. The data collected in the case of a contact form is shown on the respective contact form. The fields marked with * are mandatory. All other information can be provided voluntarily by the person making the enquiry.
The basis for the processing of your personal data is the legitimate interest of WEMF in processing your enquiry. If the purpose of contacting you is to fulfil a contract to which you are a party or to carry out pre-contractual measures, this constitutes an additional basis for processing your personal data.
You can object to this data processing at any time. Please send your objection to the following email address: datenschutz@wemf.ch. In this case, your enquiry will not be processed further.
The data you enter in the contact form will be erased as soon as your enquiry has been completed. This is the case if it can be inferred from the circumstances that the matter in question has been conclusively clarified and the erasure does not conflict with any statutory retention obligations.
4. Registration for events
When you register for events, your details from the registration form will be stored for the purpose of processing the registration and holding the event. The data collected as part of a registration process is shown on the respective registration form. The fields marked with * are mandatory. All other information can be provided voluntarily by the person registering.
When using video conferencing systems for online events, WEMF uses service providers within the scope of commissioned data processing.
The basis for the processing of your personal data is the legitimate interest of WEMF in administering and conducting the event. If the registration serves to conclude or execute a contract, this constitutes an additional basis.
You can object to this data processing at any time. Please send your objection to the following email address: datenschutz@wemf.ch. In this case, your registration may not be processed further and your participation in the event can no longer be guaranteed.
5. Registration
You can register on this website and to use the data tools of WEMF in order to use additional functions on the site or to gain access to the data tools. The data entered for this purpose will be used exclusively for the purpose of using the respective offer or service for which you have registered. This also includes platform-based communication with you. In addition, WEMF evaluates data relating to your use of data tools to optimise or improve its own services and products, as well as for statistical purposes. The mandatory information requested during registration must be provided in full. Otherwise, the registration will be rejected.
Users of data tools are granted access to applications, studies, statistics and databases as well as to WEMF’s data collection platforms, depending on the usage agreements concluded in each case. User details are managed on the systems of Green IT Solutions GmbH (www.greenits.ch) and Hostpoint AG (www.hostpoint.ch) in Switzerland, Immediate GmbH (www.immediate.de) and Hetzner Online GmbH (www.hetzner.com) in Germany and on the systems of Información y Control de Publicaciones (OJD) S.A. (www.ojd.es) in Spain. Customer data and all business administration are managed on systems in Switzerland.
Your consent forms the basis for the processing of your personal data. If the registration serves to conclude or execute a contract, this constitutes an additional basis.
You can de-register at any time. You can change or erase your personal data at any time. If the personal data is required for the performance of a contract or for the implementation of pre-contractual measures, premature erasure of the data is only possible if there are no contractual or statutory obligations to the contrary.
The data collected during registration is stored by WEMF for as long as you are registered on its website and/or its data tools and is subsequently erased. Statutory retention periods remain unaffected.
6. Audits
Participation in a media audit requires registration to use the WEMF data tools in order to declare the media data to be audited and to ensure customer management (see also the ‘Registration’ section).
In addition to its own employees, WEMF also commissions third parties, in particular auditing firms based in Switzerland, to carry out media audits. For the purpose of carrying out the audits, such third parties are given access to the relevant data tools of WEMF and thus to the personal data of the audit participants.
As part of the audit of the media data declared by the participant, WEMF and third parties commissioned by it may request access to the personal data of the audit participant’s customers (e.g. in mailing or subscription files containing information on subscribers of newspapers and/or magazines). Such data is used exclusively for statistical purposes in the context of auditing the declared media data (e.g. counting the number of copies sent or the number of subscriptions to a press publication). No personal evaluation takes place.
If WEMF and third parties commissioned by it store such personal data of the customers of an audit participant as part of the audit, this data will remain stored for as long as it is necessary for the preservation of evidence and for as long as statutory or contractual retention obligations exist.
7. Market and media research
Swiss survey institutes are commissioned to carry out the media studies. The market and media research studies contain data on the consumer and media usage behaviour of the study participants. The data collected as part of market and media research will be used exclusively in anonymised form for statistical purposes. Detailed information (especially regarding the evaluation of your answers) can be found in the context of the respective survey or where you provide your answers (e.g. at the respective survey institutes). Your answers to the surveys will only be evaluated, published and passed on to third parties in anonymised form.
The anonymised statistical data is refined by third parties on behalf of WEMF and published on the website or in the data tools and made available for download. Users of the data tools are given access to these studies and statistics (see also the ‘Registration’ section).
If you have consented to the processing of your personal data for the purposes of market and media research, the processing is based on your consent. Otherwise, your personal data will be processed for market and media research on the basis of the legitimate interests of WEMF.
You can revoke your consent at any time. Please send your withdrawal of consent to the following email address: datenschutz@wemf.ch.
8. Applications
If you apply for a position at WEMF, the personal data that you provide to WEMF as part of the WEMF application process will be processed. In addition to your personal details, education, work experience and skills, this includes the usual correspondence data such as email address and telephone number. In addition, all documents submitted by you in connection with the application, such as CV and references, will be processed. This data will only be stored, evaluated, processed or forwarded internally as part of your application. It may also be processed for statistical purposes (e.g. reporting). In this case, it will not be possible to draw any conclusions about individual persons.
The basis for processing your data is the legitimate interest of WEMF in processing your application. You can object to this data processing at any time and withdraw your application. Please send your objection to the person named in the job advertisement as the contact person or to the email address datenschutz@wemf.ch.
If an employment contract is concluded with you, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the application process ends without employment, your data will be erased unless you have given WEMF your consent to use your details for further application processes at WEMF and, if necessary, to contact you again.
9. Provision of contractual services
WEMF processes personal data to the extent necessary in each case to fulfil contractual and pre-contractual obligations and to provide other services requested by you, as described in this privacy policy. The personal data processed here and the nature, scope and purpose of the processing required in each case are therefore determined by the respective contract concluded with you or the services requested by you.
The data will be erased upon expiry of statutory warranty, limitation and comparable obligations.
IV. Cookies/tracking and other technologies related to the use of this website
WEMF uses cookies and similar technologies on its website in order to ensure its functionality, improve user-friendliness and provide certain content or services (e.g. web analysis, video integration, form functions).
Cookies are data that stored in your browser. Both our own cookies (first-party cookies) and cookies from third-party providers (third-party cookies) are used. Such stored data is not limited to traditional cookies in text form. Cookies cannot execute programs or transfer viruses to your computer. Most of the cookies used by WEMF are so-called session cookies. These are automatically deleted when you log out or close your browser. Other cookies remain stored on your computer beyond the respective usage process and enable WEMF or its partner companies (third-party cookies) to recognise your browser on your next visit. However, persistent cookies can also be used for online marketing, for example.
When you visit this website, WEMF actively asks you for your express consent to the use of cookies by means of a cookie banner. At the end of this privacy policy, you can access and change your current settings. You can also fully or partially deactivate or delete cookies in your browser settings at any time. Without cookies, this website may no longer be fully accessible.
WEMF may use third-party services on this website – for example to analyse usage behaviour, to measure statistical reach or to embed multimedia content (e.g. videos or maps). These services generally use persistent cookies or similar technologies (e.g. pixels, local memory objects and similar technologies) that are stored on the user’s device to analyse interaction with the website or to provide external content. WEMF itself does not transmit any personal data to third-party providers, in particular names, email addresses or other directly identifying information. However, the usage data collected by the cookies may be combined by third-party providers (e.g. Google) with other information from their own infrastructure, for example if visitors are logged in to a Google account at the same time or use other websites from the same provider. In these cases, the third-party provider will process such data on its own responsibility in accordance with its data protection guidelines. In such cases, WEMF only receives aggregated or anonymised evaluations, such as the number of page views, regions of origin or end devices used – but not information that would allow conclusions to be drawn about individual persons.
If the user does not wish to use these services, they can refuse or withdraw their consent within the cookie banner. It is also possible to completely block cookies in the browser or to selectively deactivate external scripts using additional tools.

V. Social Media
WEMF has a presence on social media platforms and other online platforms in order to communicate with interested parties and provide information about WEMF’s activities. If you visit such online platforms, personal data may be transmitted to the provider of the social network. User data may also be transmitted to a server in a third country and thus processed outside of Switzerland.
Furthermore, user data within the social media platforms is generally processed for market research and advertising purposes.
